Terms of sale and delivery for Deals of the Day

Valid from May 2020

1.1. These terms of sale and delivery apply between the Customer and Deals of the Day (hereinafter referred to as DOTD).                

1.2. DOTD is an App based platform where local traders can easily and cheaply get in touch with potential customers in the local area in the form of sending out actual offers (deals) , information about local events and general marketing , etc.                

1.3. The agreement between the Customer and DOTD is binding when the Customer has registered with DOTD and there is no right of withdrawal.                

Subscription and viewing packages

1.4. When registering for DOTD, the Customer must choose between 3 subscriptions ; Basic, Business and Pro. It applies to all subscriptions that the number of views of the Customers advertising with DOTD is paid for.                

1.5. With the Basic subscription, the subscription is free of charge. Payment is then made for the current consumption (impressions) in accordance with DOTDs current price list, cf. 1.8 . Payment is made in advance when creating the ad on DOTD.                

1.6. A Business subscription of DKK 59.00 per month. until the subscription is terminated. Payment is made for the current consumption (impressions) in accordance with DOTDs current price list, cf. 1.8 . With the Business subscription, however , the Customer obtains a 50% discount on a viewing package, cf. 1.8 , provided that the Customer has previously within the subscription period purchased 5 similar packages at full price. Unlimited use can be made of this discount scheme as long as the subscription is active, as long as the condition of purchasing 5 prior equivalent packages at full price is met.  Payment is made in advance when creating the ad on DOTD.                

1.7. A current subscription of DKK 99.00 per month. until the subscription is terminated. Payment is made for the current consumption (impressions) in accordance with DOTDs current price list, cf. 1.8 . With the Pro subscription, however, the Customer obtains a 50% discount on a viewing package, cf. 1.8 , provided that the Customer has previously within the subscription period purchased 5 similar packages at full price. Unlimited use can be made of this discount scheme as long as the subscription is active , as long as the condition of purchasing 5 prior equivalent packages at full price is met. When the customer total purchased 10,000 views for full list price (packages at half price does not count in this calculation) receive Customer free 10.000 additional views. Payment is made in advance when creating the ad on DOTD.                

1.8. Ongoing subscriptions can be terminated at any time in subscriptions on your device settings ( Acount → Subscriptions → DealsOfTheDay and terminat your subscription) and it will end, at the end of the following month.                

1.9. The prices for viewing packages are as follows (excl. VAT)

250 views - DKK 100.00  

500 views - DKK 175.00  

1000 views - DKK 300.00  

2000 views - DKK 500.00  

5000 views - DKK 1,000 00  

10,000 views - DKK 1,500.00                                                        

1.10. DOTD is at all times entitled to change prices on both viewing packages and subscriptions. For current active subscriptions, however, price changes must be notified to the Customer with at least 60 days notice by the end of one month before the price increase takes effect.              

11.1. When the Customer registers for DOTD, the Customer must submit information to bug for administration of the membership as well as information to the Customers profile page on DOTD. The customer must provide information about the name of the contact person, the company name and VAT number , address, email address , telephone number, website, payment information (NETS). All data is stored and used in accordance with DOTD personal data policy, cf. 1.16.              

Payment

12.1. The customer pays for subscriptions and views with card information which is registered through the Deals of the Day app .https://www.nets.eu/gdpr/pages/privacy-notice-for-nets.aspx, https://www.nets.eu/GDPR            

The content of the Customers advertising

1.13. The customer is responsible for ensuring that the content of advertising on the App is at all times in accordance with applicable law, that it does not infringe on the rights of third parties and that it does not contain content that may appear offensive or inappropriate, regardless of whether it may be illegal, for example - but not limited to - content of a pornographic, racist, religious and political nature, use of vulgar language, etc.      

1.14. It is up to DOTD alone to assess whether the content of the Customers advertising is in breach of section 1.13 and if this is deemed to be the case, DOTD is entitled to remove the advertisement from the platform with immediate effect. No compensation is provided for advertising , which for this reason is removed from platform.              

1.15. DOTD may terminate a membership / subscription with immediate effect if there has been a violation of section 1.13. In that case , no refund will be given of amounts already paid.              

GDPR

1.16. The customers personal data is stored and processed in accordance with DOTDs personal data policy (GDPR) set out in Appendix 1 to these terms.              

Limitation of Liability

1.17. In the case of wholly or partly breakdown of the platform ( app) from which the announcement is done, or any other conditions that cause , that the agreement advertising can not be completed within the agreed period, the Customer is entitled to be compensated for the lack of views in in the form of a preview in a later period as well as an additional free preview in the subsequent period. There comes so no refund of payment for advertising , which could not be carried out for any reason.              

1.18. In the event of a delay or deficiencies in the delivered announcement , no claims may be made against DOTD of any kind , other than what is stated in section 1. 17 .. Doth adherent t is not for loss of any kind , which the Customer may suffer as a result of delay or failure by DOTDs performance.              

Choice of law and venue

19.1. With the deviations that follow from these conditions, the general rules of Danish law in the relationship between the Customer and DOTD apply. The venue for any disputes is the Court in Sønderborg.
